Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Daqeeq ("Daqeeq", "we", "us", or "our"), including the website at daqeeqgroup.com, the Daqeeq mobile application, and the Daqeeq Business web dashboard (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Services. By using the Services on behalf of a business, you represent that you are authorized to act for that business and that the business agrees to these Terms.

2. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• Notify us immediately at info@daqeeqgroup.com if you suspect unauthorized use of your account.

3. The Services

Daqeeq provides a discovery platform for consumers and an analytics platform for businesses. Information about places — such as opening hours, menus, and availability — is provided by businesses or third parties and may change without notice. We do not guarantee its accuracy or completeness.

AI features (including Sabi and the Daqeeq Business insights chat) generate responses automatically. Responses are provided for informational purposes only and may contain errors. You should independently verify important information before relying on it.

4. Business Accounts and Connected Platforms

• Business users may connect third-party accounts (such as Instagram, TikTok, or Google Business Profile) to Daqeeq Business. You may only connect accounts you own or are authorized to manage.
• Your use of connected platforms remains subject to those platforms' own terms. We may suspend or remove a connection if required by the platform or by law.
• You retain ownership of your business content (menus, photos, descriptions). You grant us a non-exclusive, worldwide license to host, display, and distribute that content within the Services for the purpose of operating the Services.

5. Subscriptions and Payments

• Some features of the Services are offered under paid subscription plans. Prices, features, and plan limits are presented at the point of purchase and may change with notice.
• Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period.
• Except where required by law, payments are non-refundable.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Post false, misleading, defamatory, or infringing content, including fake reviews or ratings.
• Interfere with or disrupt the Services, or attempt to access them by automated means (scraping, bots) without our written permission.
• Reverse engineer, decompile, or attempt to extract the source code of the Services.
• Misuse analytics or data from the Services to identify individual users.
• Impersonate any person or business or misrepresent your affiliation.

7. User Content

You retain ownership of content you submit (such as reviews and photos). By submitting content, you grant Daqeeq a non-exclusive, worldwide, royalty-free license to use, host, display, and distribute it in connection with operating and promoting the Services. You are responsible for your content and must have the rights to submit it. We may remove content that violates these Terms.

8. Intellectual Property

The Services, including the Daqeeq name, logo, design, software, and content we create, are owned by Daqeeq and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Services.

9. Third-Party Services

The Services may link to or integrate with third-party services (delivery platforms, maps, social platforms, payment processors). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAQEEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR TEN (10) KUWAITI DINARS IF YOU HAVE NOT MADE ANY PAYMENTS.

12. Indemnification

You agree to indemnify and hold harmless Daqeeq and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms.

13. Suspension and Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe your use poses a risk to Daqeeq, other users, or third parties. You may stop using the Services and delete your account at any time.

14. Changes to the Services and Terms

We may modify the Services or these Terms from time to time. We will post updated Terms on this page and update the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Kuwait, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Kuwait.
